Prize Draw Terms and Conditions

These terms apply to the free prize draw associated with the UK Health & Safety Capability Survey 2026 (the “Prize Draw”). By entering, you agree to these terms. Entry to the Prize Draw is separate from your survey responses and does not require consent to receive marketing.

Important: People outside the UK may complete the research survey if invited to do so, but they are not eligible to enter this Prize Draw.


1. Promoter

The promoter is Phoenix HSC (UK) Ltd, registered in England and Wales under company number 06534364, with its registered office at Suite 215/216, Fort Dunlop, 2nd Floor, Fort Parkway, Birmingham B24 9FD, United Kingdom (the “Promoter”).

Health & Safety Matters is a promotional partner for the survey and Prize Draw. It is not the promoter and does not select the winners or administer the Prize Draw.

2. Promotion period

The Prize Draw opens on Monday 21st September and closes at midnight on Saturday 31st October (the “Closing Date”). Entries received after the Closing Date will not be accepted. The time recorded by the Promoter’s entry system will determine whether an entry was received on time.

 

3. Eligibility

3.1 The Prize Draw is open to individuals who are resident in England, Scotland, Wales or Northern Ireland and aged 18 or over when they enter.

3.2 The following people may not enter: directors, officers or employees of the Promoter; employees of Health & Safety Matters or Western Business Media who are directly involved in the promotion; anyone professionally connected with the survey or Prize Draw; and members of the immediate family or household of any such person. “Immediate family” means a spouse or civil partner, parent, child or sibling.

3.3 Entrants must comply with any rules or policies that apply to them, including any employer requirements relating to participation or acceptance of prizes.

3.4 Only one entry is permitted per person. Entries made by agents, organised groups, third parties, automated services, scripts or other bulk methods are not permitted.

3.5 Internet access and a valid email address are required.

 

4. How to enter

4.1 To enter, during the promotion period you must:

  • complete and submit the UK Health & Safety Capability Survey 2026 through the official survey link; and
  • after submitting the survey, follow the separate Prize Draw link and submit the Prize Draw entry form with your name, valid email address and any requested eligibility confirmation.

4.2 No purchase, payment or marketing consent is required to enter. Normal internet or mobile data charges imposed by your provider may apply.

4.3 Prize Draw contact details will be collected separately from survey answers and will not be linked to those answers. The content of a survey response will not affect an entrant’s chance of winning.

4.4 Entries that are late, incomplete, corrupted, illegible, submitted through an unofficial route, contain materially false information or breach these terms may be rejected. Duplicate entries will be treated as one entry or disqualified where there is evidence of deliberate circumvention.

4.5 The Promoter is not responsible for entries that are not successfully received because of a technical failure or other event outside its reasonable control. Proof that an entry was sent is not proof that it was received.

 

5. Prizes

5.1 There are four prizes. Each winner will receive one electronic Amazon.co.uk Gift Card worth £150. The total value of all prizes is £600. A maximum of one prize may be won by each person.

5.2 Prizes are non-transferable and no cash alternative is available. If a stated prize becomes unavailable for reasons outside the Promoter’s reasonable control, the Promoter may provide a substitute of equal or greater value.

5.3 Use of an Amazon.co.uk Gift Card is subject to Amazon’s applicable gift-card terms and conditions. Amazon is not the sponsor or administrator of, and is not otherwise associated with, this Prize Draw. Amazon and related marks are trademarks of Amazon.com, Inc. or its affiliates.

 

6. Winner selection

6.1 Within five working days after the Closing Date, four winners will be selected from all valid entries using a verifiably random computer process. The Promoter will retain an auditable record of the draw. Four reserve winners may be selected at the same time and in the same manner.

6.2 Every valid entry has an equal chance of being selected. Survey answers, job role, organisation, sector and any optional marketing preference will not affect the outcome.

 

7. Notification and claiming a prize

7.1 The Promoter will email each selected winner within two working days of the draw using the address provided on the Prize Draw entry form.

7.2 A selected winner must respond within seven calendar days of the notification and may be asked to provide reasonable evidence of age, UK residence or identity. The Promoter will not request payment or bank details to release a prize.

7.3 The Promoter will make reasonable efforts to contact each selected winner, including sending a reminder where appropriate. If a selected winner does not respond within the claim period, is ineligible, cannot provide reasonably requested verification, rejects the prize or has breached these terms, the prize may be forfeited and offered to a reserve winner selected in accordance with clause 6.

7.4 Entrants are responsible for providing an accurate email address and checking their inbox and spam or junk folders. The Promoter is not responsible if a winner cannot receive the prize because the winner supplied incorrect details or their email system rejected the message.

7.5 The prize will normally be sent electronically to the verified winner within 30 days after the winner accepts it and completes any reasonable verification.

 

8. Winner information

8.1 To demonstrate that valid awards took place, the Promoter will make available the surname and county of each winner to anyone who sends a request to marketinghub@phoenixhsc.co.uk within three months after the Closing Date.

8.2 An entrant may object to their surname or county being made available, or may ask for the amount of information made available to be reduced, by emailing marketinghub@phoenixhsc.co.uk. The Promoter may still be required to provide winner information and evidence of the draw to the Advertising Standards Authority or another competent regulator if challenged.

8.3 Winners will not be required to take part in publicity. The Promoter will obtain separate consent before using a winner’s name, image, testimonial or other personal information for publicity or marketing.

 

9. Personal data

9.1 The Promoter is the controller of personal data collected through the Prize Draw entry form. It will use that information to administer the Prize Draw, verify eligibility, contact winners, deliver prizes, handle queries or complaints, prevent fraud and meet legal or regulatory obligations.

9.2 The Promoter will process entry details where necessary to administer the Prize Draw in accordance with these terms, for its legitimate interests in operating and protecting the integrity of the Prize Draw and, where applicable, to comply with legal obligations. Entry details will not be used for marketing unless an entrant gives a separate, optional marketing consent. Withholding or withdrawing marketing consent will not affect entry or the chance of winning.

9.3 Prize Draw details will be kept separate from survey responses and will not be used to identify or enrich an individual’s survey answers. Health & Safety Matters will not receive survey response-level data linked to Prize Draw entrants.

9.4 Personal data may be shared only where reasonably necessary with service providers involved in administering the draw or delivering prizes, professional advisers, law-enforcement bodies or regulators. Service providers may process data only on the Promoter’s instructions and subject to appropriate protections.

9.5 Entry records will normally be retained for six months after all prizes have been fulfilled. Limited winner and draw-administration records may be retained for longer where reasonably necessary to demonstrate compliance, resolve a dispute or meet a legal obligation. 10. Fair administration and disqualification

10.1 The Promoter may carry out reasonable checks to verify entries and protect the integrity of the Prize Draw. It may reject or disqualify an entry where it has reasonable grounds to believe that an entrant has provided false information, manipulated the entry process, used an unauthorised automated method, interfered with the promotion or otherwise breached these terms.

10.2 The Promoter will administer the Prize Draw fairly, promptly and efficiently and will keep appropriate records of valid entries, the random selection process, winner contact and prize fulfilment.

10.3 The Promoter’s decisions on the administration of the Prize Draw are final, subject to applicable law and regulatory oversight. This does not prevent an entrant from making a complaint under clause 14.

 

11. Changes, suspension or cancellation

11.1 The Promoter may change, suspend or cancel the Prize Draw only where circumstances outside its reasonable control make this necessary. Any action will be proportionate, consistent with fair treatment of entrants and communicated through the same channels used to promote the Prize Draw where reasonably possible.

11.2 The Promoter will not change the Closing Date or other material conditions in a way that disadvantages entrants unless required by circumstances outside its reasonable control or necessary to avoid serious unfairness, fraud, illegality or technical failure.

 

12. Liability

12.1 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights, or any other liability that cannot lawfully be excluded or limited.

12.2 Subject to clause 12.1, the Promoter is not responsible for loss or damage that was not reasonably foreseeable or that results from circumstances outside its reasonable control. Nothing in these terms affects an entrant’s statutory rights.

 

13. General

13.1 If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

13.2 A delay or failure by the Promoter to enforce a provision does not waive its right to enforce that provision later.

13.3 These terms and the Prize Draw are governed by the laws of England and Wales. Courts in England and Wales will have jurisdiction, but residents of Scotland or Northern Ireland may also bring proceedings in their local courts and retain any mandatory rights available to them under local law.

13.4 These terms will remain available at the published terms link for at least three months after the Closing Date.

Please include enough information for the Promoter to investigate, but do not send sensitive personal information unless requested through a secure channel.

Making a complaint to the Promoter does not affect any right to complain to the Advertising Standards Authority, the Information Commissioner’s Office or another appropriate body.
